Do Adopted Children Become Mahram? Hijab and Gaze Rulings Explained
Question
Assalamu Alaykum Shaykh,
If a man were to adopt a girl, must they start to lower my gaze and make her abide by the rules of the hijab with him too – similarly as would to a Non-Mahram would do to him?
And would it be the same for a woman adopting a son?
Answer
Alhamdulillah, wassalatu wassalamu ala rasulillah, wa ala alihi wa sahbihi ajmain.
1. The Shari Context
In Islam, adoption in the sense of caring for and raising a child is highly encouraged and rewarded. However, it does not change the child’s lineage or legal rulings of mahram relationships.
Allah says:
“Call them by their fathers’ names; that is more just in the sight of Allah.”
Surat al Ahzab 33:5
This verse clarifies that lineage is preserved, and therefore rulings related to mahram and non mahram remain based on biological or established legal relationships such as breastfeeding.
At the same time, Allah commands modesty:
“Tell the believing men to lower their gaze and guard their modesty.”
Surat al Nur 24:30
2. Scholarly Discussion
The scholars of the four madhahib agree that adoption alone does not establish mahram status.
This means:
- An adopted child is not automatically treated like a biological child in matters of hijab and seclusion
- The rulings of non mahram interaction apply after the child reaches maturity
However, scholars also explain that mahram status can be established through breastfeeding (radaa) if the child is breastfed within the early years of life according to the conditions recognized in fiqh.
If such breastfeeding occurs, the child becomes a mahram, and the rules of hijab and seclusion between them are lifted.
3. Relevant Usul Principle
يحرم من الرضاع ما يحرم من النسب
What is prohibited through lineage is also prohibited through breastfeeding
This principle means that breastfeeding establishes the same mahram relationships as blood relations. So just as a biological child becomes a mahram permanently, a child who is breastfed under the valid conditions also becomes a mahram. In this case, although adoption alone does not create a mahram relationship, breastfeeding changes the ruling, removing the requirements of hijab and non-mahram interaction.
Final Ruling
Adoption does not create mahram status. If a man adopts a girl or a woman adopts a boy, then after the child reaches puberty, the rules of non mahram interaction apply, including hijab and lowering the gaze. However, if a valid breastfeeding relationship is established in infancy, the child becomes a mahram and these rules do not apply.
And Allah knows best.
