Can someone with a rare genetic disorder take permanent measures to become infertile?

Alhamdulillah, wassalatu wassalamu ala rasulillah, wa ala alihi wa sahbihi ajmain.

1. The Shari Context

Islam encourages marriage and procreation, and having children is among the objectives of marriage. At the same time, the Sharia recognizes situations of harm, hardship, and medical necessity, and provides concessions when needed.

Allah says:

“And do not throw yourselves into destruction with your own hands.”
Surat al Baqarah 2:195

And the Prophet said:

“There should be neither harm nor reciprocating harm.”
Sunan Ibn Majah

Permanent sterilization generally affects one of the fundamental purposes of marriage, which is the preservation of lineage. Therefore, the default ruling is that it is not permitted without a valid and serious justification.

2. Scholarly Discussion

The scholars of the four madhahib generally agree that permanent sterilization is not permissible under normal circumstances, because it permanently removes the ability to have children.

However, they also recognize exceptions in cases of necessity or serious harm, such as:

  • When pregnancy poses a significant risk to the life or health of the individual
  • When there is a high likelihood of transmitting a severe genetic disorder that would result in serious suffering

In such cases, many contemporary scholars permit permanent measures if the harm is established and significant, and if the decision is supported by reliable medical expertise.

They also emphasize that less drastic alternatives should be considered first, such as temporary contraception, if those options are sufficient.

3. Application to the Question

If a person has a rare genetic disorder, the ruling depends on the severity and likelihood of harm.

If the condition is such that:

  • There is a high probability of passing on a serious and harmful disorder, or
  • Pregnancy itself would cause serious harm or danger,

then permanent measures to prevent pregnancy may be permitted.

However, this is not a general allowance. It requires:

  • Reliable medical confirmation
  • A clear understanding that the harm is significant
  • Consideration of whether temporary methods could achieve the same purpose

If the risk is mild or uncertain, then permanent infertility would not be justified.

4. Relevant Usul Principle

الضرورات تبيح المحظورات بقدرها
Necessities permit what is otherwise prohibited, but only to the extent required

This principle means that when a real necessity exists, something normally prohibited may become permissible. However, this permission is limited to what is necessary. In this case, permanent infertility may be allowed only when the harm is serious and cannot be reasonably avoided by less drastic means.

Final Ruling

Permanent measures to become infertile are not permissible in normal circumstances. However, if a person has a serious genetic disorder with a high likelihood of causing significant harm, and this is confirmed by reliable medical advice, then such measures may be permitted as an exception. This should only be considered when necessary and after exploring less permanent alternatives.
