Acting Without a Fatwa When Faced With Urgent Dilemmas
Question
Salam Imam, what should we do when we are faced with a dilemma which requires a fatwa, but we cannot receive one in a timely manner? For example, if I didn’t know whether something was pure or impure, and the time of prayer is coming. What should one do while he is still ignorant?
Answer
Alhamdulillah, wassalatu wassalamu ala rasulillah, wa ala alihi wa sahbihi ajmain.
1) Acting According to One’s Knowledge
Allah says: “Allah does not burden a soul beyond its capacity.” (al-Baqarah 2:286).
If a Muslim is faced with a situation where he does not know the ruling and cannot access a fatwa in time, he should act according to the best of his knowledge and intention. At that moment, Allah does not burden him with what is beyond his reach.
2) Example: The Case of the Cast
Suppose someone had a cast on his arm due to an injury. He thought he could not perform wudu, so he did tayammum instead. Later, he learns that the correct ruling was to make wudu and wipe over the cast.
- If he truly had no access to scholars or resources at the time, then he is not sinful. His action was based on what he reasonably thought was correct.
- However, if he had easy access to a scholar and chose not to ask, then he bears sin for neglecting to seek clarification, because Allah commanded: “Ask the people of knowledge if you do not know.” (al-Nahl 16:43).
3) Ignorance and Responsibility
- Ignorance is excused until knowledge is made accessible.
- Once the correct ruling is known, one must follow it going forward. Past acts are valid unless they are invalid by clear consensus.
4) Balance: Seeking Knowledge Without Obsessiveness
A believer should always strive to seek knowledge and act upon guidance. At the same time, he should avoid falling into unhealthy waswas (obsessive doubts).
- Constantly questioning every action with “What if I did it wrong?” or “What if there’s another ruling?” can lead to hardship and anxiety, which Allah has not placed in this religion.
- The Prophet ﷺ said: “This religion is easy, and none makes it difficult except that it overwhelms him.” (Bukhari).
- The proper approach is: seek clarification where reasonably possible, act with sincerity on what you know, and trust that Allah accepts your deeds.
Final Ruling
If a Muslim acts based on his sincere understanding when no fatwa is accessible, he is not sinful. If knowledge was available but ignored, then he is accountable for neglect. A believer must strike a balance: seeking knowledge when possible, but avoiding obsessive doubts that complicate the religion and lead to anxiety. Islam was revealed as a path of guidance and ease, not constant distress.
